*A Los Angeles-based nurse who decided to take a photo of a female patient who had gouged out her own eyes with pencils, is being sued – along with the hospital and its administration – because the photo has now gone viral on the Internet, according to the patients’ attorney.
The unidentified plaintiff, purposely not named in the lawsuit, was treated at Los Angeles County-USC Medical Center in 2012 after she attempted suicide by jamming the pencils through her eyes at another facility and was rushed to the hospital, according to her lawyer, Douglas Johnson.

The woman was left blind by the injury according to the lawsuit, filed on Monday, October 20, in Los Angeles Superior Court.
The photograph was taken by the as-yet unidentified nurse with the “intact pencils sticking out of her eyes.” The nurse subsequently shared the unauthorized photo with someone else, who then passed the image to Joshua Shivers, the lawsuit said.
Once the photo got into Shivers hands, he decided to use his mom’s computer to post the image to a “shock” website, the suit stated, adding that the photo has since been viewed more than 192,000 times.
The website to which the photo was posted remains a mystery. But here is a photo although I am unsure if it is the actual woman.
“Everybody knows that as soon as someone gets their hands on something like this, it goes viral and the harm is done,” said Douglas, who has since asked that the photo be removed from the Internet by exercising a copyright they hold over photo, since it was taken in their facility.
County spokesman David Sommers said officials are investigating the allegations in the lawsuit, and he declined to comment further.
The woman is said to be moving on with her life, but is depressed because of the photo. She is learning to read Braille. The lawsuit also names as defendants Joshua Shivers and his mother, Linda. They could not be reached for comment.
